Affiliate Terms of Use

These Affiliate Terms of Use (“Agreement”) govern your participation in the Breathe First Affiliate Program (“Program”).
By applying to or participating in the Program, you agree to be bound by the terms set out below.

Please read this Agreement carefully before registering or promoting Breathe First as an affiliate.

1. Participation in the Program

Your participation in the Program is strictly for the purpose of promoting Breathe First in a lawful manner and earning commission on eligible
memberships and products purchased by customers you refer via your website or personal referral links.

By signing up to the Breathe First Affiliate Program, you confirm your acceptance of this Agreement and all related terms and conditions.

2. Approval or Rejection of Applications

We reserve the right to approve or reject any Affiliate Program application at our sole discretion. Rejection of an application does not entitle
the applicant to any legal recourse or explanation.

3. Commissions

  • Commissions are paid monthly.
  • Referred customers must remain active for a minimum of 31 days for a commission to become eligible.
  • Affiliates may not refer themselves and will not earn commission on their own purchases.
  • Commissions are only paid on transactions that are successfully completed.
  • Transactions that result in refunds, chargebacks, or failed payments are not eligible for commission.

4. Termination

Your affiliate status may be suspended or terminated if you engage in any of the following:

  • False, misleading, or inappropriate advertising claims
  • Spam activity (including mass email or bulk posting)
  • Promotion on websites that contain or promote illegal activity
  • Failure to disclose the affiliate relationship where required by applicable laws or regulations
  • Infringement of Breathe First intellectual property or trademarks
  • Offering rebates, cash-backs, or incentives derived from affiliate commissions
    (Bundling or adding bonuses alongside Breathe First products is permitted)
  • Self-referrals, fraudulent activity, or suspected affiliate fraud

Breathe First reserves the right to terminate any affiliate account at any time, with or without cause.

Affiliates may use approved text and graphic links on their websites and within email communications. Promotion may also take place via approved
online or offline channels such as magazines or classified advertisements.

You may use marketing assets provided by Breathe First or create your own, provided they are accurate, appropriate, and compliant with this
Agreement.

6. Coupon and Deal Promotion

Breathe First occasionally issues coupons to selected affiliates or newsletter subscribers.

  • Only affiliates who are explicitly approved may promote branded coupons.
  • Misleading language implying unauthorised discounts is not permitted.
  • Bidding on terms such as “Breathe First coupons” or “Breathe First discounts” is prohibited.
  • Cookie-setting techniques such as pop-ups, pop-unders, iframes, or forced redirects are not allowed.
  • Users must clearly view deal details before any affiliate cookie is set.
  • Affiliates may not advertise “click for coupon” messaging when no valid offer exists.

Violation of these rules may result in immediate removal from the Program.

7. Pay-Per-Click (PPC) Advertising

PPC bidding on Breathe First brand terms is not permitted without prior written approval.

8. Liability

Breathe First will not be liable for indirect or consequential damages, including loss of revenue or commissions, arising from tracking failures,
technical issues, or interruptions to the Program.

No express or implied warranties are made regarding the operation of the Program or the products and services offered.

9. Term of the Agreement

This Agreement begins upon acceptance into the Program and remains in effect until terminated.

Breathe First may modify these terms at any time. Continued participation in the Program constitutes acceptance of any updated terms.

10. Indemnification

You agree to indemnify and hold harmless Breathe First, its officers, employees, partners, and affiliates from any claims, liabilities, damages,
or expenses arising from your participation in the Program, including misrepresentation or failure to comply with applicable laws.

11. Electronic Acceptance

This Agreement is an electronic contract. By completing the affiliate application process, you acknowledge and agree that your electronic acceptance
carries the same legal force as a handwritten signature.
